Lot Validation at 5532 NE 50th Ave - Second Decision
Portland Permitting & Development opened a second public input period for a proposal to establish a new legal lot at 5532 NE 50th Ave. This is a follow-up decision to a nearly identical validation process that PP&D opened in December 2024. The original decision stated that the property conveyed, or transferred ownership through a deed or other formal document in 1982. PP&D staff later found that the property did not convey until 1989, so the city opened this second public input period
Validating the lot allows the property owner to develop the site. According to Oregon state law, the site may qualify as a valid lot “if it could have complied with the applicable criteria for the creation of a lawfully established unit of land in effect when the unit of land was sold.”
For 5532 NE 50th Ave, the sale of the property occurred on May 26, 1982. In 1982, Cully was not yet annexed to the City of Portland. 5523 NE 50th Ave was in an unincorporated portion of Multnomah County (i.e., not part of a city), so the relevant criteria for establishing a unit of land come from Multnomah County code.
The current land use decision only concerns validation of the lot, which would enable development in the future. The city is not deciding whether to permit any specific development on the site at this time.
